Giveaway Sweepstakes
OFFICIAL RULES
NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.
A PURCHASE OR PAYMENT OF MONEY WILL NOT IMPROVE THE CHANCES OF WINNING.
The Night Vision Sweepstakes (the “Sweepstakes”) is intended for legal residents of the United States of America (“USA”) and shall only be construed and evaluated according to applicable USA law and state law. Do not enter this Sweepstakes if you do not have residency in the USA or are otherwise ineligible to enter in accordance with these Official Rules at the time of entry.
SPONSOR/ADMINISTRATOR
The Sweepstakes is sponsored by THP Tactical Group, LLC, with official address 8 The Green, STE A, Dover, DE 19901 (the “Sponsor”).
ELIGIBILITY
The Sweepstakes is open only to legal residents of the USA who are at least eighteen (18) years of age or have reached the age of majority in their state of residence at the time of entry (the “Entrants”). Employees, officers, and directors of the Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and members of their immediate families (spouse, parents, siblings, and children, regardless of where they reside) and household members are not eligible to participate. Void where prohibited or restricted by law.
AGREEMENT TO OFFICIAL RULES
By participating, Entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes. Winning a Prize is contingent upon fulfilling all requirements set forth herein.
SWEEPSTAKES PERIOD
The Sweepstakes begins at 12:00:01 a.m. Eastern Time (“EST”) on September 19, 2025, and ends at 11:59:59 p.m. EST on October 3, 2025 (“Sweepstakes Period”). The Sponsor’s database is the official timekeeping device for this Sweepstakes. The potential winner will be announced on or about October 6, 2025.
HOW TO ENTER
Two (2) methods of entry are available:
1. Purchase Method
During the Sweepstakes Period, Entrants who make a purchase through Sponsor’s online shop at www.refactortactical.com will automatically receive one (1) entry into the Sweepstakes for every whole dollar spent.
Certain eligible products may carry entry multipliers (e.g., 2x or 3x entries per dollar spent). For example, an eligible product with a 3x multiplier may provide three (3) entries for every $1 spent. The number of entries received will be based on the pre-tax amount of the eligible purchase, excluding shipping/handling charges and less any discounts.
All purchases are final even those on a pre-sale basis. Fraudulent or abusive purchasing behavior intended to generate entries will result in disqualification at Sponsor’s discretion.
2. Mail-In Method of Entry (AMOE)
To enter without making a purchase, Entrants must legibly hand-print their full name, complete mailing address, phone number, email address, and date of birth on a 3”x5” card or paper and mail it in a standard #10 business envelope, with proper postage, to: RE Factor Sweepstakes Entry, PO BOX 4964, Boise, ID 83711
Each properly submitted mail-in entry will receive the same number of entries as a purchase of $1 during the Sweepstakes Period, including any applicable multipliers in effect at the time of entry. For example, if a 3x multiplier is available on the website during a given day, a mail-in entry postmarked that day will receive 3 entries for each $1 equivalent.
All mail-in entries must be postmarked by October 3, 2025 and received no later than October 6, 2025. Limit: One (1) mail-in entry per envelope. Bulk shipments of entries will not be accepted.
LIMITS
There is no limit on the number of entries an Entrant may obtain, provided that each entry complies with these Official Rules and is obtained via a valid method of entry (purchase or mail-in).
PRIZES
• Grand Prize: Fully built Night Vision Helmet [Ops Core FAST Bump Helmet - DTNVS White Phos Night Vision, Wilcox G24 Mount - Ops Core AMP Headset] with an estimated total value of $10,000
• Additional secondary prizes may be awarded at Sponsor’s discretion.
The total prize pool ARV is estimated at $10,000 Actual value may vary.
Winner is solely responsible for all taxes and any other expenses associated with acceptance and use of the prize. Prize will be awarded “AS IS” without warranty of any kind.
WINNER SELECTION AND ODDS
The potential Grand Prize Winner will be selected in a random drawing conducted on or about October 6–10, 2025 from among all eligible entries received during the Sweepstakes Period. Odds of winning depend on the total number of eligible entries received.
WINNER NOTIFICATION
The potential winner will be notified by phone, email, and/or USPS mail. Winner must complete and return any required Affidavit of Eligibility, Liability/Publicity Release, and IRS Form W-9 (if applicable) within three (3) business days of notification. If a winner cannot be contacted, fails to provide required documentation, or is otherwise disqualified, Sponsor reserves the right to award the prize to an alternate Entrant.
GENERAL CONDITIONS
If for any reason the operation or administration of this Sweepstakes is impaired or incapable of running as planned for any reason, including but not limited to (i) infection by computer virus, bugs, (ii) tampering, unauthorized intervention, (iii) fraud, (iv) technical failures, or (v) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to: (a) disqualify any individual who tampers with the entry process or the operation of the Sweepstakes; and/or (b) cancel, terminate, modify, or suspend the Sweepstakes in whole or in part at any time, without notice, and award the Prize(s) using all non-suspect eligible entries received as of, or after (if applicable), this cancellation, termination, modification, or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules.
Sponsor further reserves the right, at its sole discretion, to disqualify any individual deemed to be (i) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or Sponsor’s website; (ii) acting in violation of these Official Rules; or (iii) acting in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER LEGAL REMEDIES (INCLUDING ATTORNEY FEES) FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
RELEASE AND LIMITATION OF LIABILITY
By participating in the Sweepstakes, Entrants agree to release, indemnify, and hold harmless the Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, suppliers, distributors, and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim, liability, injury, loss, or damage of any kind arising, in whole or in part, directly or indirectly, from Entrant’s participation in the Sweepstakes or receipt, use, or misuse of any Prize.
Without limiting the generality of the foregoing, Entrants agree that the Released Parties are not responsible for: (i) any incorrect or inaccurate information, whether caused by Entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines, internet, network hardware, or software; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (v) any late, lost, misdirected, garbled, incomplete, or undeliverable entries; or (vi) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt, use, or misuse of any Prize.
Entrant further agrees that in any cause of action, the Released Parties’ liability shall be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
For residents of New Jersey: Nothing herein bars recovery of damages or attorney’s fees where mandated by statute.
Except as expressly provided above, IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND ARISING OUT OF PARTICIPATION IN THE SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE.
PUBLICITY
Except where prohibited, participation in the Sweepstakes constitutes Entrant’s consent for Sponsor to use Entrant’s name, likeness, and biographical information for promotional purposes without additional compensation.
DISPUTES
Except where prohibited, Entrants agree that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts located within the State of Delaware. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Entrants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules that would cause the application of any other jurisdiction’s law.
WINNER VERIFICATION & TAXES
The Grand Prize Winner will be required to complete and return an Affidavit of Eligibility and Liability/Publicity Release, and may be required to complete and return an IRS Form W-9 (for U.S. residents) within the time period specified by Sponsor. The value of the prize is taxable as income, and the Winner is solely responsible for all applicable federal, state, and local taxes associated with acceptance and use of the prize. Sponsor will issue an IRS Form 1099 to the Winner for the actual value of the prize if the value equals or exceeds six hundred dollars ($600).
WINNERS LIST REQUEST
To obtain the name of the Winner (first name, last initial, city, and state of residence), send a self-addressed stamped business-size envelope to: Night Vision Sweepstakes – Winners List Request, PO BOX 4964, Boise, ID 83711.
Requests must be received no later than November 30, 2025.
SEVERABILITY & MISCELLANEOUS
If any provision of these Official Rules is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect. These Official Rules constitute the entire agreement between Entrant and Sponsor regarding the Sweepstakes and supersede all prior communications and understandings, whether written or oral, relating to the Sweepstakes. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to modify these Official Rules at any time in order to comply with applicable laws or regulatory guidance.
FORCE MAJEURE
Sponsor shall not be responsible or liable for any failure to perform or delay in performance of its obligations under these Official Rules that is caused by events outside its reasonable control (“Force Majeure Event”). Such events include, but are not limited to, acts of God, fire, flood, earthquake, storm, or other natural disaster, war, civil unrest, terrorist threat or act, riot, labor strike, epidemic, pandemic, government order or regulation, or failure of public or private telecommunications networks. In the event the Sweepstakes is canceled, terminated, modified, or suspended due to a Force Majeure Event, Sponsor reserves the right to award the Prize(s) in a manner that is fair, equitable, and consistent with the spirit of these Official Rules
